Welcome to Element Care. These Terms of Service govern your use of our website, products, services and related interactions with Element Care.
By accessing our website, purchasing products, booking services or engaging with Element Care, you agree to be bound by these Terms of Service.
1. About Element Care
Element Care provides automotive care services and related retail products, including but not limited to:
- Paint Protection Film (PPF)
- Window Tinting
- Ceramic Coatings
- Vehicle Detailing
- Vinyl Wrapping
- Automotive Accessories
- Retail Consumables & Automotive Care Products
Throughout these Terms, “Element Care”, “we”, “our” and “us” refers to Element Care.
2. Quotes & Pricing
All pricing displayed on our website, social media platforms or quotations is subject to change without notice.
Quotes provided by Element Care are generally valid for 14 days unless otherwise stated.
Due to the customised nature of many automotive services, final pricing may vary depending on:
- Vehicle condition
- Vehicle size or modifications
- Additional labour requirements
- Product availability
- Requested changes to scope of work
Customers will be notified of any major pricing changes prior to work proceeding where reasonably possible.
3. Service Bookings
Deposits
Certain services may require a deposit to secure a booking.
Deposits assist in covering scheduling allocations, labour preparation and material procurement.
Deposits are generally non-refundable unless otherwise agreed by Element Care.
Vehicle Collection
Customers are responsible for collecting vehicles within a reasonable timeframe following notification that work has been completed.
Element Care reserves the right to charge reasonable storage or holding fees for vehicles left uncollected without prior arrangement.
Delays
Estimated completion times are provided as a guide only and may vary due to supplier delays, weather conditions, curing times, staffing availability or unforeseen circumstances.
Element Care is not liable for indirect losses resulting from service delays.
4. Certified Contractors
Element Care may engage trusted and certified third-party contractors to perform or assist with certain services where appropriate.
Contractors are selected to support service quality, technical capability and operational efficiency.
By booking with Element Care, you acknowledge and accept that work may be completed partially or entirely by approved contractors operating under the Element Care service network.
5. Vehicle Condition & Risk Acknowledgement
Customers acknowledge that automotive services may involve interaction with delicate surfaces, trims, plastics, paintwork and previously repaired components.
Element Care is not responsible for:
- Pre-existing paint damage or defects
- Weak, repainted or previously repaired paintwork
- Improper prior installations
- Manufacturer defects or deterioration
- Wear and tear consistent with vehicle age and condition
- Mechanical or electrical failures unrelated to services performed
Certain services, including PPF, vinyl wrapping and tint removal, may expose underlying defects or weaknesses that existed prior to service commencement.
Customers accept these risks when authorising work.
6. Product Sales
Element Care sells automotive products, consumables and accessories through its retail platforms.
Customers are responsible for ensuring products are suitable for their intended application prior to purchase.
Product images, colours and descriptions are provided as accurately as possible but may vary slightly due to screen settings, supplier revisions or manufacturing tolerances.
7. Returns & Refunds
Returns, cancellations and refund requests are governed by our Returns & Refund Policy.
Approved refunds are subject to a non-refundable 5% administration fee to cover operational and transaction costs.
Change of mind returns may be subject to a 15% restocking fee, inclusive of the administration fee.
8. Warranty & Aftercare
Any manufacturer warranties applicable to products or films remain subject to the manufacturer’s own terms, conditions and assessment processes.
Element Care will reasonably assist customers with warranty-related enquiries where possible.
Customers are responsible for following all recommended aftercare instructions provided following services.
Failure to follow aftercare guidance may void applicable workmanship or manufacturer warranty coverage.
9. Limitation of Liability
To the maximum extent permitted by law, Element Care is not liable for:
- Indirect or consequential losses
- Loss of income or business opportunity
- Vehicle downtime
- Third-party expenses
- Loss arising from misuse of products
- Damage caused by third parties after service completion
Where liability cannot be excluded under Australian Consumer Law, Element Care’s liability is limited to the resupply, repair or replacement of the relevant goods or services where permitted by law.
10. Website Use
By using our website, you agree not to:
- Use the website for unlawful purposes
- Attempt to interfere with website functionality or security
- Copy or reproduce website content without permission
- Misrepresent yourself or submit false information
Element Care reserves the right to restrict or terminate website access where misuse is identified.
11. Intellectual Property
All branding, logos, website content, graphics, photography and media produced by Element Care remain the intellectual property of Element Care unless otherwise stated.
Content may not be reproduced, distributed or used commercially without written permission.
12. Privacy
Element Care may collect customer information required to process orders, bookings and enquiries.
Information is handled in accordance with our Privacy Policy and applicable Australian privacy laws.
13. Changes to Terms
Element Care reserves the right to update or modify these Terms of Service at any time without prior notice.
Continued use of our website or services constitutes acceptance of any updated Terms.
14. Australian Consumer Law
Nothing within these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
